Indiana License Suspension Issues

When you are arrested for an OWI in Iowa, the police officer will request that you submit to chemical testing. Under Indiana’s implied consent laws, you are required to submit to this testing. If you refuse, your driver’s license will be suspended under a civil action for a period of time. You will have the right to challenge this suspension at a judicial hearing. There are strict time limits associated with this hearing. The attorney general’s office will represent the state at this proceeding.

The length your driver’s license suspension will depend on various factors. A refusal case is a term that the driver refused to submit to chemical testing. If you refuse, the suspension is 12 months; and Second offense refusal is a 2 year suspension. If you submit to chemical testing and fail the test, the suspension is 180 days or until your case is resolved.
