Kansas License Suspension Issues
When you are arrested for a DUI in Kansas, the police officer will request that you submit to chemical testing. Kansas has implied consent laws requiring your to submit to chemical testing. If you refuse, your driver’s license will be suspended under a civil action for a period of time. You will have the right to challenge this suspension at a judicial hearing. There are strict time limits associated with this hearing.
The length your driver’s license suspension will depend on various factors. A refusal case is a term that the driver refused to submit to chemical testing. If you refuse, the suspension is 12 months; a Second offense refusal is a 2 year suspension; and a Third offense refusal will result in 3 year suspension.
If you submit to chemical testing and fail the test, the suspension is 30 days; a Second through Fourth offense, your license is suspended for 1 year. For your fifth violation, your suspension is permanent.
The suspension of your license takes effect the 30th day following the notice. You must file your request with-in 10 days of this notice. If you fail to file the petition, the suspension goes into effect. The administrative hearing is conducted by the Kansas Department of Revenue.
