South Dakota DUI Penalties
When you operate a motorized vehicle in the State of South Dakota and are under the influence of alcohol or drugs, you can be convicted of a criminal offense called Driving under the Influence. The DUI becomes a felony offense when it is your 3rd DUI Offense. Convictions that are more than 10 years old do not count in determining how many prior DUIs you have. - Imprisonment –up to 1 year
- Fine – $1,000
- License Suspension – 30 days to 1 year
Second DUI Conviction
- Imprisonment – up to 1 year
- Fine – $1,000
- License Suspension – 180 days to 1 year
Third DUI Conviction
- Class 6 Felony Offense
- Imprisonment – up to 2 years
- Fine – $2,000
- License Suspension – 1 year
